I've been asked what the response from UPS was.

Blah, blah, This was in my view, the correct course of action and it would not be appropriate for me to now re-investigate or re-open these matters, more blah, given these circumstances, and also the fact that you are no longer an empoyee of the Company, blah, we will not be writing to you further blah, blah

Yikes, nearly cocked up

UPS used some delaying skull-duggery but my claim has been accepted by the employment tribunal.

I got an e-mail that looked very sus. which I binned, it was a name with only document 1 attached.

This must have prompted Roger's reply, followed by a letter from their solicitors.

As a letter from ACAS then didn't make sense, I remembered the dodgy looking e-mail and retrieved it from my recycle bin.

Everything began to make sense.

[4.2.1] are required to exercise integrity, honesty, diligence and appropriate behaviour in all their business, professional and related personal activities.

[4.2.2] must act within the law and must not encourage, assist or act in collusion with employers, employees or others who may be engaged in unlawful conduct.

You are one of the UPS people and you are a member of the CIPD (Although you failed to confirm this when I asked).

Do you think that you have complied with either of the above policies?

Have you been honest?

I understand that you believe that my first grievance was dealt with correctly, even though it was based on lies.

I understand that I raised my third grievance on leaving the Company. (The exit interview that I never had, and was never followed up on when I requested one)

However, you have failed to mention my second grievance, which to date remains un-answered. This was raised whilst I was still an employee of the Company.

You have again failed to follow Company procedures on the disciplinary process and have also used delaying tactics. Why has it taken over 4 months to ask a few questions?

You have also failed to answer any of the issues raised in my resignation letter. I even had to ask for confirmation of an acknowledgement.

You have also failed to supply any information that I have requested over the past 5 months.

As you must have investigated all my correspondence professionally, I would like to request copies or at least details, of the statements made by UPS employees during the course of your investigation (internal enquiries). As the response to my first grievance was a pack of lies, false information or choosing not to remember (delete as you think appropriate) I would like to see which UPS employees continue to be dishonest and continue the attempted cover up of the lack of integrity amongst UPS Managers. I would especially like to see Richard Watts’ answer to you, as he had already confirmed to me that I had raised issues about Dean Weir. I would also like to see the answer given by Craig McIntosh. I would also request details of the information, and by whom, given to HSE, in relation to a complaint that I had raised with them. The HSE said issues had been resolved. I would like to know who gave that false information, as the issues still continue.

I would also ask that you cease to use ‘Yours sincerely’ at the end of your correspondence to me. I think the following definition sums up why I think it is very inappropriate.

Carl Palmer Band

Imagine if you will the greatest venue Holmfirth has ever had.


Take possibly the greatest, biggest & most imaginative prog rock band ever, Emerson, Lake and Palmer. Simmer over a low heat for about 20 years, then remove some of the contents.
Remove the Emerson, what? no Emerson!!
Remove the Lake,
Remove the pyrotechnnics,
Remove the revolving Pianos
the rising drums
& the daggers.

What remains. Carl Palmer.

It's 8, yes unbelievably 8 years since we saw him at the Oakwood Centre in Rotherham (CRS gig)

So, basically the drums of ELP, mind you those are mighty fine drums, no keys or vocals. It was a surprise then,when we turned up to see a setup for 3 piece, bearing in mind that it had been publish that Pictures at an exhibition would be on the menu.

There was no support, so at 8.30 the CPB fired into Welcome back my friends.........setting the standards for the evening.

Awesome is a much over-used word these days to the point that awesome more or less means average. This was an immense gig. Other than a few effects pedals, just guitar, drum & bass. (& one electronic pad for CP, as far as I could see).

Guitars were provided by Paul Bielatowicz, Paul played with Carl 8 years ago, & is the Neil Morse connection mentioned on the Forum.

Bass was provided by Simon Fitzpatrick. An excellent bass solo of Stairway to Heaven with some Matt Stevens style looping in there.

Who needs Keith Emerson? Clearly not CPB, Simon played bass like it was lead guitar with some Stu Hamm style playing, Paul effortlessly replacing Emmo's keys without being too flash.

Set list was, in no particular order, and with a couple of ommissions;

I've been busy

Unfortunately I'm not allowed to publicise what I've done...........Yet.
But I can say that I'm waiting for a reply from ACAS.

Managed to get in my first full round of golf last night. Only a couple to go & I'll beat last years total that was allowed by UPS.

Just to prove we made it to the end,here's gig'n'golf buddy Nige, (as opposed to workmate and sacked driver Nige) about to tee off on the 18th at Low Laithes.



Finally decided on Carl Palmer tomorrow night, rather than It Bites. Absolutely no idea why really, would prefer to be omnipresent and go to both. Typical that they both clash. Could be the fact that Carl is at the Picturedrome that swayed it for me, or that It Bites are touring fairly regularly these days, or that Carl is playing Pictures. if anyone knows the real answer please let me know, I've know idea.

A few things from today, mainly prompted by comments on the radio.

Rhetoric – In relation to the UK Government. (Language that is elaborate, pretentious, insincere, or intellectually vacuous). Sounds exactly like your presentation on Commitment to Integrity and the Policy book.

Government unpopular due to incompetence. I don’t think UPS is incompetent. It’s deliberate and planned.

Government say all the right things but don’t follow through. Sounds just like UPS

Government is reactive not proactive, UPS are neither.

Come down from the Ivory Tower into the real World and open your eyes. Maybe you should do that too.

A comment from a driver based at Irlam, Manchester. (Scott Fowler’s old centre, he of the stay out until 22.00 statement.) The drivers are under so much pressure that they take their break at the end of the day, in the canteen.
This must be seen and ignored by the Management.
Why would any driver sit around in the canteen for an hour after work?
Unless he wanting paying for a break, that he hadn’t taken.

I can supply the drivers name if you need it, but I’m sure you will know already that it’s true. (Unless you haven’t investigated)

I kept hearing over the last few years at UPS, accountability. Who is accountable? Does it only apply to the drivers and not the Management?

Steve O’Donnell hasn’t been accountable, all the way up to Cindy Miller. So where does the accountability start?

Value of UPS - Mikey's economics lesson

To continue my earlier post,

I can't find the info, and google doesn't give me a quick answer, but I think that UPS has around 77 billion shares. Currently at a value of $80, that gives a total of $6,160 Billion. Hmm, maybe those figures aren't right.

Mind you, 2011 revenue was $51.1 Billion
Anyway, just think how much a $1 drop in share price would affect the Company, bearing in mind that since Sept the share price has gone up $20.

Now there's a challenge.

Market Cap = Value = $73.33bn
Share price = 76.43
Number of Shares = 959,440,010
x $4 (Fall in share price)
= $3,837,760,041

Add 73.33 & 3.8 and that's near enough the $77bn I quoted before.
Mixed up the value with the number of shares.



Just think if I'd been responsible for that 4 point fall



& the target price for the next 12 months is 91, so a good investment, unless you have some inside information which might affect the share price.

Just a reminder of a few items that you might want to consider tomorrow.

My first grievance highlighted the lack of integrity in the Company.
This was basically, ignored.
The grievance hearing took no action.
My information was classed as old hat.
Despite this claim, I was able to produce a list of 475 Centreboards that had been despatched out on road. These had all occurred since a conversation with Lisa Bradshaw, H.R.
H.R. obviously failed to take any action as the lack of integrity continued.
This lack of action covered up the integrity issues within UPS in the UK.
The following Centres were involved, including that of Chris Marchant who held the grievance meeting. Presumably, why my grievance was swept under the carpet.

I think that shows a fairly comprehensive and conclusive list. There aren’t many UK Centres that aren’t on the list. So if almost every Centre is on the list, why do they need to cheat? Some had up to four Centre boards.

The list of 8 Centre Managers at Dewsbury can be added to that list, although most would already be included in the list of Centres.
The list of 5 Division Managers can also be added, although there is a name on both lists.
From H.R., Roger Mays, Emma O’Toole & Lisa Bradshaw are also complicit in the cover up.
On top of this we can add the UK & Ireland Operations Manager.
Finally topping the UK list is the District Manager.

This is a pretty convincing roll call to prove my original point.

There has been no follow up to my 2nd & 3rd grievances, which had additional evidence to back up grievance number one, although there must have been a grain of truth in there somewhere, as the driver mentioned in grievance 3 was re-instated.

Compliance and Ethics department have failed to live up to their name, although this doesn’t surprise me as Cindy Miller said that she had come from a background of Compliance & Ethics.

UPS helpline also failed to follow-up – Ref IWF_17CD3FC0B5.

Will you be backing all these employees and continuing to turn a blind eye to this lack of integrity or will you be standing by the Company Policy book and your Managing with Integrity presentation?

Here are a few of your phrases. I have the screen prints, if you have forgotten your speech.

  • You can’t build a long standing reputation on slippery ethics.
  • And report potential violations to the Company
  • You build it by gaining trust…..by leading with integrity.
  • It means refusing to engage in unethical activities.
  • It is essential that no employee is retaliated against.
  • For using our reporting mechanisms.
  • That support the UPS legacy of leading with integrity.
  • Or our culture of Compliance.

This of course only deals with the integrity issues that I raised. There is bullying, intimidation, harassment and retaliation, false statements to Doctors and to Government agencies. Details of which you’ve had already.

We haven’t covered Aviation Security yet.
Any thoughts on why approx. 50 Centres in the UK had their X-ray operation closed down?

I would suggest cost cutting in training.

UPS trains for 4 hours. UPS gives the trainees the questions during the training session. UPS allows the trainees to discuss the answers while the trainer is out of the room. This compares with DHL’s 3 day training course. Once arranged, these training sessions take place, irrespective of a shortfall of drivers. If necessary sub-contractors are used. How often is UPS training cancelled to avoid Sub-contract costs?

DHL also take security seriously. DHL don’t pretend to lock the gates.

We haven’t discussed which time zone you are in. I would think that Hawaii is the state that is the furthest west. As Hawaii is 11 hours behind the UK, then Friday would end at 11.00 BST on Saturday. I don’t think that I can say fairer than that. I think somewhere like Guam would already be into Friday.

I don’t expect a reply from you, but at least I can’t say that I didn’t try hard enough and give you, or one of your minions, the opportunity to respond.

Assuming that you won’t respond, in the current climate of share-holder accountability, how do I call for a vote of no confidence in the chairman & CEO of UPS? Is there a procedure in place or would I have to write an open letter to somewhere like the New York Times? But you’re no going to reply anyway, are you?

UPS (NYSE: UPS) today announced first quarter 2012 diluted earnings per share of $1.00, a 10% improvement over the prior-year period. Consolidated revenue increased 4.4% to $13.1 billion. Operating profit for the U.S. Domestic and Supply Chain and Freight segments increased 13% and 19%, respectively.

I received a letter today from the Health & Safety Executive dated 3rd May 2012.
As you can see below they have decided that there is no need to follow up on my concerns as the issued have been addressed.
There are no details supplied as to how this resolution has been achieved. I can only guess that this is in response to statement that has been made by UPS.

If this a correct assumption that I have made, what exactly has changed?

I spoke to a driver today (@13.03) when he should have been on his dinner break. (i.e. no work at all.) Technically the DIAD records would show that he was on his break. He had been told to falsely declare a dinner break in his DIAD. It was no surprise to find that he was still on road driving and delivering and that he was planning to take his dinner break at the end of his allocated work, approx. 17.00.

Not only are UPS covering up the infringements by falsely instructing a driver to key a break in his DIAD, but again there is a lack of integrity within the UPS Management in instructing the driver to do this. Who was it that decided this was to be the way to resolve the Working Time issues? Was it Steve O’Donnell, before he was transferred, (he who destroyed the infringement letters) or was it his replacement, Scott Fowler, (he who stated that drivers should stay out until 22.00 to complete their deliveries and collections, where necessary). I have been making this statement now for four months, no-one is denying that this had been said; even though it was omitted from the notes of Nigel Harnell’s disciplinary.

Are productivity & therefore profits that important to UPS?

An audit of the driver’s timecards, as I have suggested in the past, will highlight these infringements, and if you say that there is no-one available or that it isn’t cost effective, then why is it possible to audit drivers who are suspected of being under-despatched?

I’m sure that if the relevant driver’s timecard is audited for today, that the audit will show that the driver was delivering through his alleged dinner break, when comparing his actual delivery records to his recorded break. In fact I will challenge you to prove me wrong. The driver today was Jeremy Peel.

So I ask again, how has this issue been resolved?

When are UPS going to halt the cover-ups?

The integrity issues that I raised in my first grievance were covered up by lies.

The lies in response to my grievance have been covered by silence, since no-one has responded to my 2nd grievance, 3rd grievance or correspondence.

I can’t believe that there is no-one in the Company who will stand up and be counted. Are the Management scared of the retribution if they do?

Two final questions for today, I received another answer to an e-mail today,

                                UPS is no longer out client at ComplianceLine.  Please forward your e-mails to the new hotline vendor for UPS.

Why is UPS no longer a client of ComplianceLine? A lack of compliance?
Who is the new hotline vendor?

If the issue has been addressed, then I must have raised a relevant concern.

If the concern still continues, then the concern has not been addressed.

Therefore this should justify further investigation.

I can only guess that UPS have told you that the issue has been addressed. If this is the case then UPS are continuing to be dishonest. Drivers not taking the correct breaks are a danger to both themselves and the general public. The laws are in place to protect the general public and UPS are ignoring these issues.

Thank you for your prompt reply.  I have just tried phoning you to ask a couple of further questions.

You say in your email that the vehicles are less than 7.5 tonnes but are they over 3.5 tonnes?  You also said that neither of the vehicles are tachographed but in your original complaint you stated that the company were ignoring tachograph regulations - are you referring to some other vehiclesin this case?  Sorry to ask so many questions but I do need to establish the correct enforcing authority.  If I were to investigate your complaint, can I disclose that you have made a complaint and ask for your specific timesheets?

I only deal with the Working Time Regulations and wouldn't be able to deal with the other issues you mentioned (i.e. the bullying, intimidation etc).  This would be more a management issue to be dealt with internally if possible.
