Defer bonuses for 10 years to avert risk-taking, report suggests
The long-awaited parliamentary review of the British banking system has advocated jailing senior executives who are found guilty of reckless misconduct.
“Too many bankers, especially at the most senior levels, have operated in an environment with insufficient personal responsibility,” explained the report from a cross-party group of MPs.
The committee recommended a new ‘senior persons regime’ to replace the current ‘approved persons regime’. This would assign major responsibilities within banks to specific individuals, who were then held accountable for decisions and standards within their given areas.
A criminal offence of reckless misconduct in the management of a bank should be created for these ‘senior persons’, and should carry a custodial sentence, added the MPs.
The recommendations were in the final report from the Parliamentary Commission on Banking Standards, set up by chancellor George Osborne last year after a number of scandals in a sector already reeling from the financial crisis of 2008.
Remuneration, standards, culture and the role of government and regulators across the industry had already been examined by the commission.
The end review recommended that a greater proportion of bankers’ pay and bonuses should be deferred, and for longer – by up to 10 years. It added that any outstanding incentives should be cancelled in the event of a state bail out of a bank.
The committee went on to outline other failings in financial institutions, such as an overly masculine culture. It called for more women on trading floors and suggested that banks should be required to publish gender ratios.
The commission added that the action of governments and financial regulators “have contributed to the decline in standards”, and called for faster reforms and better enforcement.
“Risks and rewards in banking have been out of kilter,” said Andrew Tyrie, the Conservative MP who chaired the parliamentary commission. “Given the misalignment of incentives, it should be no surprise that deep lapses in banking standards have been commonplace.
“The health and reputation of the banking industry itself is at stake,” he continued. “Many junior staff who may have done nothing wrong have been impugned by the actions of their seniors. This has to end.
“This is not a bank bashing report,” insisted Tyrie. “I hope the higher standards it advocates will help revive the banking sector and the UK generally.”
The CIPD welcomed the commission’s findings, but warned that its recommendations were insufficient in themselves to change banking culture.
The institute said that improved leadership from the executive board to the front-line, more employee consultation opportunities and a greater focus on training and development were required.
“Banks need to re-evaluate their core purpose and the values which should define their behavioural expectations and norms,” explained CIPD chief executive Peter Cheese. “A key part of this is to re-consider their longer term duty to customers, shareholders and the wider stakeholders they impact, including the communities in which they work.
“Employees need to be able to understand and relate to the purpose and values at every level. This needs to be reinforced through how leaders and managers behave on a daily basis and how they are recruited, managed, developed and promoted.”
He added: “If we define corporate values in practical and meaningful ways, we can define organisational cultures that are truly values-driven and which are lived, breathed and consistently reinforced through actions and behaviours day-in-day out, from top to bottom.”
Research released by the CIPD earlier this month revealed that two-thirds of bankers felt that some people in their company were still being rewarded in a way that incentivised inappropriate behaviour.
Only four in ten of the 1,000 respondents in the banking sector said that there had been an initiative led by senior executives to change the culture in their organisation over the last 12 months.
The report, Rebuilding Trust in the City, also found that three in ten employees thought senior bankers should be imprisoned where there was evidence of gross misconduct or negligence leading to substantial failure – such as a taxpayer bailout.

Nothing strange there I hear you say, except there's no content to that post, just a reference to a post about Steve O'Donnell, which is almost a year old.

Maybe the content of that post is stirring some interest.

Major businesses 'supplied names' to register of banned workers
Concerns about blacklisting in the construction industry, and HR’s role in it, were reignited this week when the BBC’s Panorama programme claimed major construction companies had regularly supplied names for a secret register of employees.
Previous information about the secretive firm behind the list, The Consulting Association (TCA), suggested that the illegal database of more than 3,000 names had been run and accessed by a few rouge individuals.
However, Mary Kerr, who ran TCA with her husband Ian Kerr, claimed that HR professionals had supplied many of the names and personal details that were then used to exclude candidates from major construction sites across the UK.
She also alleged HR directors and officers routinely called her office to use the list to screen job candidates for a whole range of jobs, not just building professionals.
The programme interviewed people who claimed they had been victimised for raising health and safety concerns or for being members of a union and placed on the list maliciously. The workers said they had been excluded from sites for years, including many large publically funded projects such as Crossrail and the Olympic Park.
Panorama’s expose follows an ongoing inquiry by the Scottish Affairs Select Committee into the list that labelled workers as ‘trouble-makers’.
At the time members of the committee said they were “appalled” that established firms had funded a “systematic blacklist”, and they also criticised employers for not taking full responsibility.
Responding to questions raised by Panorama, a CIPD spokesperson said: “The institute is conducting a small number of investigations, under its Code of Professional Conduct, into members alleged to have used TCA services.”
The CIPD was unable to discuss the matter further as its own investigations are ongoing. But membership could be revoked if evidence is found that people have broken the rules of the code of conduct.
However, the institute also told People Management that, separate to the Code of Conduct investigations, “chief executive Peter Cheese is pressing for a wider debate on the topic, which would extend beyond the construction industry”. This will examine what is and isn’t legitimate when vetting employees. The CIPD is understood to be talking to a range of stakeholders in the debate, including HR and other industry representatives, with the objective of producing guidance relevant to today’s world of social networks and digital tools.
The extent of illegal blacklisting among construction companies was first revealed in March 2009, with more than 40 employers implicated.
Between them the firms had paid nearly £480,000 for information about job applicants from The Consulting Association from April 2006 to February 2009.
This group included well-known companies such as Sir Robert McAlpine Ltd and Skanska.

    Top 100 bosses enjoy 10 per cent pay hike in a year, survey reveals

But reward complexity hides true value of soaring payouts
Pay for the UK’s top 100 chief executives grew by 10 per cent between 2011 and 2012 putting average staff wage rises in the shade, a major pay survey has revealed.
Bosses in the FTSE 100 took home an extra £45 million (10 per cent) in 2012 compared to the year before, according to the Total Remuneration Survey 2013 by Manifest and MM&K.
Such hikes in pay are a marked contrast to average employee wage rises of 2.5 per cent in the private sector, as reported by Incomes Data Services earlier this year, and the 1 per cent cap for public sector increases.
In fact total remuneration for this privileged few has increased faster than shareholder returns during the past 14 years. And as the growth in reward has been “almost entirely” driven by pay for performance policies, the report said, this shows such initiatives are not working.
For example, payouts from Long Term Incentive Plans, intended to link reward and company performance more closely, were up 40 per cent from 2011.
In addition to concerns that pay for performance policies are not working, the report also said that the complexity of valuing deferred bonuses hides and understates the reality of growth in total remuneration. The report said that real increases for top 100 bosses are actually about 8 per cent higher than figures quoted.
Deborah Hargreaves, director of think tank the High Pay Centre, said: “Once again, this unnecessary hike in executive pay shows that performance-related pay structures are completely flawed. They are too easy to reach, and reward business leaders for being in the right place at the right time rather than successful, sustainable management of their company.
“Executives have seen their rewards racing ahead of the rest of the workforce. Pay for everyone else has been frozen or failed to keep up with inflation. This leads to a great sense of injustice in the workplace. It is time for company boards to look at a major overhaul of executive pay."
The news comes as Burberry chief executive Angela Ahrendts became the first woman to top Britain's pay league with a total pay package of £16.9m, while the £17.6m remuneration package of WPP's Sir Martin Sorrell is threatening to spark a shareholder revolt this week.
